While surrogate parenting is a commercial transaction, a child is being treated as a commodity and the surrogate mother could be seen as selling the use of her body.
The child is described as being the child of the mother giving birth. The only lawful way in which the child can become legally the child of the parents who commissioned the surrogate parenting is by adoption, by-passing all normal loopholes.
There are cases where the husband is the biological father of the child, in which case he is possibly obliged to commit adultery (the alternative being a transfer of his sperm by some other means).
The surrogate mother’s hormones will have been working overtime and she will find it hard to give up the child. Moreoever, if she refuses to do so, there is nothing the couple can do, as it would be an unlawful contract which no court could uphold.

All these children will end up wheelchair bound for the rest of their lives and it can lead to a short life expectancy.
Josh is the happiest boy I know with a wicked sense of humour and personality to match and should be admired for his courage.
